Gujarat HC issues notice to State GST over Harassment

Ahmedabad : Gujarat High Court has issued notice to the State GST department in response to a petition filed by a man claiming the State GST officials had stationed inside his house for more than a week and initiated action without following due procedure contemplated in the law.

Trader Paresh Chauhan has claimed in the plea that he runs project consultancy finance and is proprietor of Lancer Enterprise at Ramol.

However, he has given his factory premises and machinery on lumpsum rent for job work and does not deal with manufacturing activity or trading.

The State GST officials had sealed his office situated at 431, Devnandan Mall, near MJ Library on Ashram Road on October 8.

On October 11, they visited his house at Aryavrat Heights, near Prernatirth Derasar Road in Satellite to inquire about him and then an investigation was initiated.

Chauhan further claimed that, since October 11, the State GST officials had stationed in the flat round the clock and his family members were not allowed to go out of the house.

Even during night hours, they stayed put in the flat without being accompanied by any female staff.

“The State GST officials camped inside the house until the HC issued them notice on October 19 after we filed a petition on October 17.

We have raised the issue of high-handedness of the department without following due procedure of law. The matter has been scheduled for further hearing on October 24,” said Chetan Pandya, Chauhan’s lawyer.
